The short story is that the court refuted a previous judge’s ruling that photos were newsworthy, saying that “people are nude every day and the news media does not typically find the occurrence worth reporting.” The fact that photos were published without the permission of Nancy’s family, nor did they recieve compensation from the magazine after the fact, didn’t help Hustler’s case either. That said, they have the right to appeal the judgment.
